The event focused on three key documents in Alberta’s legal system that are especially important for newcomers: the 𝐖𝐢𝐥𝐥, 𝐄𝐧𝐝𝐮𝐫𝐢𝐧𝐠 𝐏𝐨𝐰𝐞𝐫 𝐨𝐟 𝐀𝐭𝐭𝐨𝐫𝐧𝐞𝐲 (𝐄𝐏𝐀), 𝐚𝐧𝐝 𝐏𝐞𝐫𝐬𝐨𝐧𝐚𝐥 𝐃𝐢𝐫𝐞𝐜𝐭𝐢𝐯𝐞 (𝐏𝐃). The session was led by Givalatha T.Balasingam, senior legal counsel at Shim Law, who shared practical legal insights and answered a wide range of thoughtful questions from attendees. Introductory guidance and community context were provided by Sergiy Golovko, who moderated the session and delivered the presentation in Ukrainian. We were pleased to see such strong participation from the Ukrainian community - even in the middle of summer - and are proud to support legal literacy and empowerment through initiatives like this one. Last time, I talked about the misconceptions in the criminal law. There's also often myths about how the criminal courts work. Clients can have misplaced expectations about their trials, sentencing, or the role of judges and lawyers. Here are four misunderstandings that I always encounter from time-to-time: 1.“Isn't my court appearance on my paperwork my trial date?” A lot of folks misconceive how the process works and even simple cases take months to get ready to even set a trial date. Just had one of my clients email that they can't make their trial date due to a family vacation. Um, it's just the first appearance and we just got the docket number finally three days before your CMO date. Take as much vacation time as you need. The court backlogs and disclosure process take clients by surprise. Their day in court isn't instant. 2. “Just get me a good deal to resolve this, I don't want to deal with this.” We negotiate ECR plea deals but can't underestimate the importance of preparing the client for that one time a judge exercises discretion. Joint recommendations don't override precedents and sentencing guidelines. 3. “The police violated my rights, why isn't my case being dismissed?” Yeah, that Section 24(2) discretion does make any minor procedural errors no guarantee of it even if you win the point. They won't aim to punish the police just because if the adjudication of the case on its merits test takes the match. 4. “I can represent myself. You cost too much.” Kind of risky. Court is complicated, and the stakes are high. Lawyer shows on TV so often mislead folks on how the rules of evidence and legal arguments actually work. If you're calling me an attorney, you're already doing it wrong. Ensuring your clients understand how the court system really works can help them make better legal decisions. If they're facing charges, get 'em informed.
