Montu has long advocated for reform in NSW driving regulations to ensure that legally prescribed medical cannabis patients who are unimpaired are not unfairly penalised for having THC present in their system. We commend Independent Members Alex Greenwich MP, Joe McGirr, Greg Piper MP and Jeremy Buckingham for their leadership and collaboration in calling for this important reform in NSW Parliament. Their joint advocacy represents a critical step toward protecting patients across NSW. NSW patients are forced to choose between taking their prescribed medication and driving. The ability to drive is fundamental to independence. It enables people to get to and from work and stay connected to family and community. Under the proposed model, NSW Police Force will still be able to charge anyone driving while impaired. However, if a person is not impaired, they should not face criminal penalties or lose their licence simply because THC remains detectable in their system. Medicinal cannabis patients should be treated with the same respect and fairness as any other person on prescribed medication. Montu has provided its submission to the Therapeutic Goods Administration (TGA) consultation on Australia’s regulatory framework for medicinal cannabis. As a leader in Australia’s #medicinalcannabis industry, we want safe, evidence-informed clinical practice that ensures patients can access appropriate treatments without undue barriers. Drawing upon the expert consensus of the Roundtable on Supporting High-Quality, Evidence-Based Medicinal Cannabis Care in Australia chaired by Professor Ian Freckelton AO KC, we urge a shift from the overburdened temporary SAS-B and Authorised Prescriber (AP) pathways to a streamlined, evidence-driven system that preserves patient access and safety. We propose six key elements: 1. Real-world evidence (RWE) Leveraging secure extraction of de-identified electronic medical records for building evidence of safety and effectiveness; 2. Unified prescriber framework Replace SAS-B and AP with one national authorisation process that integrates training, registration and jurisdictional rules; 3. Product oversight Create a ‘Declared Medicinal Cannabis Products’ category on the ARTG to allow TGA to require quality standards without requiring full registration dossiers; 4. Education standards Embed a medicinal cannabis curriculum across undergraduate, postgraduate and continuing professional development programs, aligned to the National Prescribing Competencies Framework; 5. THC-CBD dose equivalence Standardise dosing and labelling akin to oral morphine-equivalents, enabling safer, more consistent prescribing; and 6. Evidence-proportional psychosis safeguards Ensure any regulatory action on THC-containing products is in accordance with established hierarchies of evidence. By integrating these we can ensure safe patient access, strengthen evidence generation, and enhance clinician confidence. Montu endorses AHPRA (Australian Health Practitioner Regulation Agency)’s updated guidance as a critical step forward in facilitating high-quality, patient-centred medicinal cannabis care in Australia. This is a vital and welcome update, and as the sector leader, we have long advocated for tighter clinical standards, robust real-time prescription monitoring, and the treatment of medicinal cannabis with the same care and caution as any other controlled medicine. The guidance released today is well aligned with our existing clinical protocols and internal governance practices. But there’s more work for the sector to do. That’s why we’ve convened two major initiatives to help shape the future of care: 🔹 An expert Rountable of clinicians, academics, patient advocates and specialists led by Professor Ian Freckelton AO KC to develop proposals for long-term regulatory reform 🔹 The Telehealth Sector Working Group, chaired by former Health Minister Professor The Hon Greg Hunt, which brings together leading digital health providers to design national best practice standards. These co-developed C.A.R.E. Telehealth Principles are currently in their public consultation phase.
