The Government of N. Macedonia announced few days ago that it has prevailed in three investment arbitrations based on three different BIT's. The Latest one was brought before ICSID, Artem Skubenko and others v. Republic of North Macedonia (registered as ICSID Case No. ARB/19/9). The dispute concerned termination of a copper mining concession by the Government. It was brought under the Macedonia Ukraine BIT of 1998. The Second one is an ad hoc arbitration, under UNCITRAL arbitration rules of 1976. It was brought by Blazo Tasev, under the Macedonian Slovenian BIT of 1996. It also concerned mining sector, and a bankruptcy proceedings of the SASA Mine. The Third one is an ICC case raised by the Turkish Company Gama Güç Sistemleri under the Macedonian Turkey BIT of 1995. It is worth mentioning that several years ago, North Macedonia prevailed in another treaty based arbitration, raised by the Indian Investors Binanies under the Macedonian Indian BIT of 2008. The dispute arose concerning a mining concession and bankruptcy proceedings in Macedonia. It also included motion for setting aside in the Country where the award was rendered, and a request for Recognition and enforcement abroad under the New York Convention of 1958. It was a privilege for me to work alongside with lawyers from White &Case and Ashurst and Orrick on these four investment arbitration cases, where the State prevailed.
