San Francisco Partner Mark Wilson obtained a positive verdict in an Employment Law case at the Fourth District Court of Appeal! In this case, originally led by San Diego office Managing Partner Al De La Cruz and San Diego Partner Christine La Vorgna, Plaintiff sued our client for disability and religious discrimination after being terminated for a lack of communication with their supervisor and not providing timely doctor’s notes. The jury returned a favorable verdict for our client, finding it was a religious entity outside of the Fair Employment and Housing Act (FEHA). Plaintiff appealed the decision and challenged the multi-factor test they submitted that determined our client was a religious entity. In addition to challenging the test, Plaintiff alleged that our client’s attorneys committed misconduct during the trial. Congratulations to San Diego Partner Yury A. Kolesnikov and Los Angeles Partner Geoff Plowden for securing a significant victory for the City of Santa Monica and its Deputy City Attorney in the United States District Court for the Central District of California. The case began with Plaintiff unsuccessfully suing the City of Santa Monica for an alleged wrist injury he sustained during an arrest in 2019, as well as several other grievances involving the revocation of his medical license in 2017.   In the present lawsuit, the plaintiff alleged that several governmental entities and officers, including multiple jurists on the state and federal benches, were part of a RICO conspiracy to deprive Plaintiff of his medical license and retaliate against him. The Magistrate Judge rejected all of the plaintiff’s claims, granting a motion to dismiss in full. New York Partner Jamie Burke and Los Angeles Partner Roya Fohrer successfully led a breach of contract case to resolution in arbitration. Our client, a think tank addressing youth homelessness, filed a claim when respondent failed to meet its payment obligations for our client’s consulting services. Mid-arbitration, Ms. Burke leveraged the contractual late fee (3% monthly interest with an 18% annual cap) instead of the statutory interest (9%), increasing our client’s total recovery. Dallas office Managing Partner David Reeder, San Francisco Partner Mark Wilson, and Los Angeles Partner James Harris successfully argued against a claim of negligent entrustment in the California Second District Court of Appeal. In this case, Plaintiff visited a motorcycle dealership in Redondo Beach to purchase a motorcycle, despite having no experience riding motorcycles nor a motorcycle license. When the dealership discovered Plaintiff wouldn’t qualify for financing, his brother volunteered to co-sign for the motorcycle. After the sale was complete, Plaintiff’s brother, who did have a motorcycle license, drove the motorcycle back to Plaintiff’s home.
