He joins us from the US Department of Justice Civil Division’s Appellate Staff, where he served as lead counsel in several high-profile appellate matters. Leif has served as lead counsel in over two dozen cases in his time at DOJ, and presented seventeen oral arguments before the federal courts of appeals and a state supreme court. Earlier in his DOJ career, he also spent several years providing advice to the White House, the Attorney General, and Executive Branch agencies as an attorney-adviser in DOJ’s Office of Legal Counsel. Resolution CD/ANPD No. 19/2024 deepened the provisions of the Brazilian General Data Protection Law regarding International Data Transfers and brought the country closer to European legislation. In its annexes, it introduced Standard Contractual Clauses, which are mandatory provisions to be executed between data controllers and processors carrying out international transfers, to ensure an adequate level of protection for exported data. On August 23, the adaptation period for the adoption of Standard Contractual Clauses under ANPD Resolution No. 19/2024 came to an end. From that date onward, International Data Transfers will only be valid if the SCCs are implemented or if other mechanisms previously approved by the ANPD ensuring an equivalent level of protection are used. Non-compliance may result in significant fines, administrative sanctions, reputational damage, and operational vulnerabilities.
