Kudos to R+C Internal Investigations + Corporate Compliance team partner David Carney, who was among the panelists at The Masters Conference Legal discussing how legal teams are leveraging advanced AI and traditional investigative tools to uncover facts in complex financial disputes.
AI, Chatbots, and the 30K Document Rule: Lessons from the J.S. Held LLC Panel in NYC Instead of pitching "robot lawyer" dreams, these panelists showed how real investigations and disputes are being solved by layering GenAI, digital forensics, structured data, and old-school legal judgment. Here’s what stood out: 1️⃣ Arnold Blair nailed it when he said, “Everyone knows emails are discoverable—people forget chat is too.” But extracting and reviewing chat data is messy, costly, and often informal. There’s still no perfect solution, but the best tech today lets you zoom in and out of chat timelines to prioritize review. 2️⃣ One lawyer in a construction litigation case claimed she "didn't know" how to write a GenAI prompt. She was advised to pretend she's instructing a junior reviewer. It worked, and the AI delivered after several rounds of refinement. 3️⃣ Sentiment analysis was used to flag pressure-laden emails (“I need this wired now!”) in fraud cases. These cues helped identify key moments and targets for deeper review. 4️⃣ Investigators used an AI Q&A tool to generate potential deposition questions and simulate the CFO’s likely responses, along with links to the underlying documents. “That’s what technology is supposed to do—empower the human,” said Mike Gaudet. 5️⃣ Whether it’s categorizing vendors or analyzing transactions, AI still misfires (like tagging “office equipment” as “entertainment.”) Manual review remains essential to catch these errors before they derail a case. 6️⃣ The goal in multiple case studies was to reduce millions of documents down to the “30K Rule”, a manageable batch for human review. AI was the scalpel here, not the surgeon. 7️⃣ The most effective workflows combined TAR, GenAI, and search tools differently depending on the matter. “No two cases are alike,” one panelist reminded us. “And we’re not at the ‘GenAI EASY button’ stage just yet”. 8️⃣ With petabytes of data and skyrocketing costs, corporations are starting to deploy AI behind the firewall for early triage—before anything gets hosted.
