- Filing a trademark. So you're ready to file a trademark. Whether you file based on use or based on intent to use, you've done what you need to be sure that you're not going to get sued for infringement by some prior user. You are sure you're going to move forward with this product and with this brand. Where do you file? There's actually a variety of ways you can file a trademark application. You can actually file in your state. It's pretty rare that businesses use state filings anymore, but for a very small fee, you can file a trademark application in any of the 50 states. You can also file a trademark application with the federal government. This is the U.S. Patent and Trademark Office, or the USPTO. Their website is uspto.gov. There's a means to file online. It's inexpensive, the fee starts at $250, if you use their predetermined forms, and the process takes 12 to 24 months, depending on whether there are objections by the USPTO.
