⚙️HITECH Act! Health Information Technology for Economic and Clinical Health Act (2009) was passed to improve healthcare by bringing health systems up to date with modern technology. It provided incentives for healthcare to use Electronic Health Records (EHRs) and strengthen the privacy and security provision of HIPAA. The Act included important updates to HIPAA related to privacy. The scope of HITECH Act is aligned with HIPAA and applies to covered entities and Business Associates. The Act introduced penalties as disincentives for organizations that violate HIPAA. Main aim is to speed up innovation in health care. 🔗The Breach Notification Rule:- 🔸Requires HIPAA covered entities and their business associates to provide notification following a breach of unsecured protected health information. 🔸The Breach Notification rule is triggered when unsecured PHI is used or disclosed in any way not authorized by law. 🔗Factors determining authorized use/ disclosure of PHI on a breach! 🔸Type of information involved and if the individual patients may be identified and or reidentified. 🔸Use and disclosure of unauthorized information by the Parties. 🔸Risk of secured PHI being mitigated. 🔸Shared PHI acquired or viewed. Some unauthorized disclosures aren’t due to negligence and may not present much risk to patients, these are not considered as breach by law and hence notifications are not required. 🔗Types of use / disclosure of PHI which not subject to breach! 🔸On a good faith, covered entity or business associate accidentally access PHI or within the scope 🔸Accidentally sharing the PHI with one another if more than one person is authorized to access the same information 🔸If covered entity believes that no unauthorized parties will be able to retain the information. 🔗Notification of PHI breach in Healthcare! 🔸Breaches which affect fewer people less than 500 individuals may be reported annually. 🔸Business Associate needs to notify Covered Entity within 60 days of breach and covered entity is responsible for rest of the notification. 🔸Covered entity is required to notify HHS of any data breach. 🔸Data breach should be notified to the victims within 60 days by the covered entity. 🔸If the breach affects more than 500 individuals in each state, it is required to notify HHS within 60 days and also notify media outlets in the form of press release. 🔸Covered entities must notify the Secretary of breaches of unsecured protected health information. 🔸Covered entities must prove that they made all appropriate notification after the breach in the form of documentation or other evidence as per HITECH Act. HITECH adds business associates directly to HIPAA, rather than through agreement with the covered entities, hence OCR can pursue enforcement actions directly with the business associates just as it does with covered entities. HITECH Act increases the fines for HIPAA violations up to $1.5 million. #privacy #databreach #healthcare
