HIPAA just greenlit PHI to ACOs for treatment. On August 13, 2025, HHS updated its HIPAA Privacy Rule FAQ. This is a big shift when ambient and agent workflows touch posting or appeals artifacts. Two reminders shape how you build: → If it is for treatment, authorization is not required. → Minimum necessary does not apply to treatment but role-based access still does. This matters when payment posting touches care coordination. Here is what changes for you: ✦ Treat it as treatment. → If the purpose is treatment, you can share to VBC participants without patient authorization. → Minimum necessary doesn’t apply to treatment; still use role-based access. ✦ Wire your agents for privacy by design. → Configure posting/appeals agents for data minimization and role-based access. → Predict likely “more info” asks; pre-attach notes, labs, and coverage criteria at submit. → Auto-log each disclosure event supporting VBC payment flows (who/what/why/time). Think of this as “Agents for PHI”: the right data, in the right hands, with a paper trail. This is not just about HIPAA text. It is a signal.
