Data Protection in Nigeria. PART 2: 8 Rules That Can Save Your Business (and Your Reputation)
“The Guiding Principles of Data Protection in Nigeria”
Let me start with a story…
Some time ago, a popular pizza chain in Nigeria was fined ₦3 million — not for bad food, but for sending marketing messages to a customer without permission.
That's the power of data protection laws today. The rules are clear, and companies that ignore them are learning the hard way.
So, what are these rules? In this second part of our series, let’s explore the eight (8) principles that guide how personal data should be handled — whether you're a telecom company, a fintech, or even an online vendor.
🔑 1. Lawfulness, Fairness, and Transparency
Your customers have the right to know what you're doing with their data — no hidden tricks or fine print.
📌 Example: Don’t sneak in marketing consents during SIM registration. Be honest, be clear.
🎯 2. Purpose Limitation
Only collect data for specific reasons. No "just in case" hoarding.
📌 Example: If you collect a phone number to verify an account, you can’t suddenly start sending promo messages — unless the user agreed.
📦 3. Data Minimization
Only take the minimum amount of data necessary.
📌 Example: Don’t ask for someone’s religion or marital status if you're just opening a prepaid mobile account. Stick to what you really need.
🔐 4. Storage Limitation & Security
Keep data only as long as necessary, and protect it like your business depends on it — because it does.
📌 Example: Leaving customer records on an old, unprotected spreadsheet is not just risky — it could land you in legal trouble.
🎯 5. Accuracy
Outdated or incorrect data can cause real harm — imagine sending a customer’s bill to the wrong address!
📌 Pro tip: Regularly update your records and let users correct their data.
🧑🏾⚖️ 6. Duty of Care
You owe a legal responsibility to protect users’ data — just like a doctor owes confidentiality to a patient.
📌 Example: If you hand over customer data to a vendor, you’re still responsible for what happens to it.
🧾 7. Accountability
If a breach happens on your watch, you can't pass the blame. Controllers and processors must show they’ve taken compliance seriously.
📌 Tip: Document everything — from consent forms to security protocols.
🧩 8. Confidentiality, Integrity & Availability
This one’s tech-heavy but simple: Make sure your systems protect data from unauthorized access, ensure data is reliable, and that it’s available when needed.
📌 Example: If customer data is suddenly “missing” or “corrupted,” it’s not just a tech issue — it’s a legal one.
🚨 Why This Matters in Telecoms
Telecoms handle massive amounts of sensitive personal data — locations, conversations, SIM details. These principles are non-negotiable. One leak could trigger a national scandal, regulatory penalties, or loss of public trust.

In Part 3, we’ll dive into what the NDPA says about “Sensitive Data” — the red flags, the do’s and don’ts, and real-life consequences.
