The Inflation Reduction Act of 2022: Sharing Our Insights on a Landmark Law

In passing the Inflation Reduction Act of 2022 (IRA), the largest piece of climate-policy legislation in US history, Congress has made a historic investment in helping the United States transition to a lower-carbon economy—and in mitigating the many harmful effects of a warming climate. Projected to drive record growth in clean energy, the landmark law will touch nearly every corner of the energy transition, and likely have far-reaching impacts for decades to come.

In short, the IRA is a game-changer. And companies that wish to play will have their work cut out for them—not only to decipher the new rules, but also to determine how best to position themselves to win. With this in mind, we at Vinson & Elkins have been engaging closely on the legislation, analyzing its numerous complex provisions and evaluating how companies can navigate the many opportunities and challenges it will present.

We’re also sharing our insights on the law. And below, we’ve compiled a selection of the resources we’ve developed or participated in so far.

Media Coverage. In a timely article published in Bloomberg Law, we examine the IRA’s four major themes: breadth, flexibility, environmental justice, and domestic strength. We also explore the law’s 15 percent corporate alternative minimum tax, the stress that the law could place on the U.S. transmission grid, and the need for detailed guidance on the novel concepts introduced in the law.

Video. In a thorough, highly detailed video, we walk through the IRA’s most important climate and energy programs and clean-energy tax provisions, unpacking their implications for the energy transition in the United States. In another video, we look in-depth at how the IRA’s tax credits will affect the U.S. offshore wind industry. Both videos have accompanying presentations available for download: energy transition and offshore wind.

Podcast. On the Renewable Energy SmartPod, we take a deep dive into the IRA’s components, focusing on how the law’s many tax incentives stand to boost the deployment of renewable energy in the United States.

Written Analyses. In seven written analyses, we:

Our IRA work has been a collaborative endeavor involving numerous attorneys and business professionals around the firm. Yet even as recent months have amounted to a massive undertaking for our IRA team, our work in this area is only just beginning. As we continue to monitor developments in Washington around regulatory guidance—and as progress toward implementing the law begins—we look forward to building on our efforts and continually sharing our insights far and wide.
