Our US customer meetup brought together a dynamic mix of founders, tech innovators and business leaders for an energising session focused on the future of recruitment, leadership incentives, and performance management.

Here's what we covered:

🎧 Founder Podcasts: recording sessions for founders to share launch stories, CVPs, and EVPs, generating valuable insights for their communities.

🤖 AI in Recruitment: Discussing AI’s evolving role, with companies like SourceWhale and Spott showcasing new features to streamline prospecting, communication, and automation.

🌐 Community Marketing: Our Fractional CMO, Chris Pollard highlighted how authentic, trust-based community-building approaches drive sustainable growth through engaging content, peer interactions, and storytelling.

🚧🔍 Navigating non-competes

One of the biggest reasons high-performing recruiters hesitate to launch their own companies is because of ‘non-competes’, and worrying about the fallout and legal ramifications of creating their own company.

💡But let’s clarify a key point – the term ‘non-compete’ itself is usually very misleading.

While many employment contracts do contain a ‘non-compete’ clause, this is virtually always unenforceable (legally), and it’s much more helpful to think in terms of your ‘post-employment restrictions’.It depends a lot on country, state etc., but in very broad terms, your previous employer has a right to protect their business from your disrupting their staff and client relationships as a result of having recently worked there.

This means you (almost always) can start a firm that ‘competes’, can work the same market… but you usually can’t (for a ‘restricted period’ after leaving, often 6 to 12m):

❌ Work with clients that you have worked with recently while employed (often in the 12m leading up to termination)

❌ Work with prospective clients who were just about to become clients when your employment was terminating

❌ Solicit / headhunt staff from your previous firm

There are 101 nuances, and it’s ALWAYS a good idea to get an experienced expert to:

📄 Review the exact language in your contract

⚖️ Develop clear lines on what is and is not likely to be legally enforceable (e.g., what you can and can’t do)

📝🚶♂️ Guide you through the resignation process – a huge amount of how things play out post-termination are linked to how you present your resignation and future plans

🤝 Support you through any follow-on issues
