Talk Like a CFR Expert
Introduction: Why This Matters
When the VA processes your disability claim, it doesn’t base its decision on personal opinion, sympathy, or storytelling. Every decision they make is guided by one authoritative source: the Code of Federal Regulations (CFR), Title 38.
If you’re a veteran filing for benefits, you may already know how frustrating it is to explain your condition and feel unheard. The truth is, it’s not just about what you say—it’s about how you say it. If your wording doesn't align with the CFR, your claim may fall short of the rating you deserve.
This month, our goal is to equip you with the knowledge to “talk like a CFR expert.” You’ll learn how the VA evaluates conditions, what legal and medical language they look for, and how to ensure your submissions speak directly to the criteria that matter most.
Understanding the CFR: Title 38
The Code of Federal Regulations (CFR), Title 38, outlines the laws and rules governing VA benefits. Part 4 of Title 38 is especially critical—it’s known as the Schedule for Rating Disabilities, and it defines how the VA determines the percentage assigned to your condition.
Key facts about the CFR:
Bottom line: You are not just submitting medical evidence—you are submitting a legal argument. The CFR is your playbook.
Section Focus: CFR § 4.130 - Mental Disorders
Let’s explore one of the most commonly misunderstood parts of the rating schedule: CFR § 4.130, which covers mental health conditions like PTSD, anxiety, depression, and adjustment disorders.
This section uses a six-tier scale, ranging from 0% to 100%. The VA is looking for functional impact—how the condition affects your life and work—not just diagnosis alone.
CFR § 4.130 Rating Breakdown:
RatingKey Indicators0%Diagnosis without symptoms severe enough to interfere with occupational or social functioning.10%Mild symptoms; occasional decrease in work efficiency; controlled by medication.30%Occasional work interference; anxiety, panic attacks (weekly or less), mild memory loss.50%Reduced reliability and productivity; difficulty with abstract thinking, panic attacks more than once a week.70%Deficiencies in most areas (work, school, relationships); impaired judgment, suicidal ideation, continuous panic.100%Total occupational and social impairment; gross impairment in communication, memory loss, danger to self or others.
Tip: Describing your condition in vague terms like “I have a hard time at work” or “I’m anxious a lot” won't meet these thresholds. You must demonstrate how your symptoms align with the specific CFR language the VA uses.
How to Write Like a CFR Expert
Many veterans get denied or underrated because they describe their conditions in casual, non-specific language.
What the VA Looks For:
They’re not looking for emotional stories—they’re looking for symptom alignment with CFR descriptors.
Use CFR-Based Language in Your Claims:
Include statements such as:
Action Step: Before submitting your personal statement or doctor's letter, compare it to the CFR criteria. If your language doesn’t match, revise it until it does.
Case Study: From 30% to 70% – A Real Example
Jason, a Marine veteran, was rated at 30% for PTSD. His original submission described symptoms like “trouble sleeping” and “feeling stressed out.” While these are real challenges, they didn’t connect with any particular rating language in § 4.130.
With assistance, Jason revised his claim to include:
“I experience panic attacks multiple times per week. I isolate myself from family and coworkers. I find it difficult to adapt to change at work and often leave tasks unfinished. I avoid public places and loud environments due to flashbacks. These symptoms interfere with my ability to maintain employment.”
The revised statement directly aligned with the 70% rating criteria.
Three weeks after submission, Jason received a new decision: his rating was increased to 70%, along with retroactive benefits.
