  • Q: Do we focus on adaption to our new climate or trying to keep below a warming threshold that can be argued we’ve already breached? A: Both! As we deal with the inevitable consequences of breaching thresholds, we are seeing all over the world numerous examples of ‘hottest day on record’ and ‘hottest month since records began’. Does that mean we stop trying to keep warming down - of course not. But we do have to be realists and adapting to the consequences of warming in cities is going to be crucial towards keeping the impact manageable. One of the best ways to keep cities cool, to keep air cleaner and a pretty good way to deal with in-city carbon absorption……..re-greening projects. Ironically before our fascination with concrete, granite and marble locked in - we inherently knew this and green spaces, along with tree lined roads, were a standard feature in most designed cities. There are numerous city re-greening projects springing up globally (Paris and Amsterdam being two great examples) and they aren’t just about creating nicer environments (although this absolutely is a brilliant side-effect); they are a key component in climate adaption! These councils are planning ahead because they know what is coming? What great re-greening projects are you seeing in your city or are you involved in?

This quote sums it up nicely “if you are a gambling B2C, B2B ( supplying services to, in or from Gibraltar), marketing co or Holdco, now is the time to start thinking whether or not the activity you perform is defined as “Regulated” and subject to licensing down the line.” Key message - changes are coming, start the discussion now - both to help the team get a complete view of the landscape to deliver appropriate transition planning; but to also ensure business continuity.

    Now that the new Gibraltar Gambling Bill has been published and is awaiting Parliamentary debate, the volume of enquiries from the sector and advisers has increased. We will be issuing administrative guidelines and draft codes once the Parliamentary debate is complete, but until then here are a few points to consider. Sections 17-19 defines the scope of B2C and B2B ( regulated activities). Gambling marketing and Holdcos ( holding more than 25% in a relevant gambling company - including outside Gibraltar) are also brought within scope. S19 defines “ providing facilities for gambling” and this now extends to managenent control in or from Gibraltar. This may capture certain multi jurisdictional models that were previously not in scope. S19 also extend the scope of what constitutes B2B activity both in or from Gibraltar, but also what constitutes licensable supply chain business to Gibraltar licensed operators. So CRM support in or from Gibraltar to an operation outside the jurisdiction may be licensable B2B activity or, if the external business is managed or controlled from Gibraltar, it may even be B2C activity. Whilst existing licensees will be “grandfathered” into the new regime, those business will need to look to see if any other functionality conducted in or from Gibraltar falls within scope. Gambling marketing companies in Gibraltar will also need to start a dialogue, ideally having taken advice, with the Gibraltar Gambling Division regarding the licensing process as the grant of marketing licenses is on a prima facie restrictive basis and at the discretion of the Licensing Authority. Gibraltar is host to a number of multi jurisdictional business models and also acts as a service centre. We will take a pragmatic approach and will be supportive of any business that does not pose a risk to the reputation of the jurisdiction. Once the Act is implemented there will be a transition period, but if you are a gambling B2C, B2B ( supplying services to, in or from Gibraltar), marketing co or Holdco, now is the time to start thinking whether or not the activity you perform is defined as “Regulated” and subject to licensing down the line. We would prefer all businesses to engage early (a) so that we have a complete understanding of all the different business models out there (b) so businesses can plan strategically by understanding our position and risk appetite. What we can’t give are opinions based on a tailored ( partial) version of the business model. Businesses will need to be clear and transparent about their models and be prepared for in depth questions. I am commited to engage ( alongside advisers) to ensure an effective and pain free transition to a new Act as possible.

    The Gambling Supervision Commission (GSC) has released a webinar on GSC Inspections. This video is the eighth in a series covering the AML/CFT inspection process from initial self-assessments to the onsite inspection and final report. This video covers Suspicious Activity Reporting, focusing on effectively demonstrating that you are meeting code requirements.   • What started many decades ago as a 'bolt on' or 'a cost of doing business' is finally being understood as a "competitive advantage". This is what a well-functioning Compliance Department looks like in a progressive and aggressively expanding market. For Hacksaw Gaming to recognise its Compliance Department as the agents that facilitate quick but safe market access, and commit to this as a "competitive advantage" in their IPO documentation shows that the business understands the importance of 'necessary friction' between the commercial desires of the business and the need to keep it safe.
