The Way We Do Business
Has Changed
In the 1990s, President Bush signed the Americans with Disabilities Act
The intent of the ADA was to provide equal access in public places such as shopping, theatres, banks,
etc., for those with disabilities.
Businesses were required to modify their locations by
adding ramps, handicap parking, automatic doors,
handicap bathrooms and other barriers.
The Internet was in its infancy and not explicitly
mentioned within the ADA.
Fast forward to today.
We now do our banking, shop, apply for a job, book a hotel room, hail a taxi - about anything you can think of…
All from the palm of our hand thanks to the Internet
NEW STANDARDS
Not long ago, mobile was not considered with digital tech and websites.
Because so many people use a mobile device, websites that look good on mobile are now a standard.
Today, businesses are ”remodeling” their digital assets in order to abide by the ADA – just like they did for
their brick and mortar business in the ’90s.
Disabled people use many assistive
technologies to access digital
content.
The most common is a screen reader
used by those who are sight impaired,
closed captions for hearing impaired.
Website owners and digital
technologies now have new standards
that have to be implemented…
WHO MAKES THE ACCESSIBILITY GUIDELINES
Web Content Accessibility Guidelines - WCAG 2.1
Are International Standards for ADA and Section 504/508
3 levels of compliance are provided: A, AA and AAA
WHO ENFORCES
The ADA is a broad law monitored by the DOJ.
Digital assets and websites can be considered places of public
accommodation and cannot discriminate against people with
disabilities by failing to provide auxiliary aids where needed.
Many lawsuits are setting precedence for future lawsuits.
FINES & LAWSUITS
First violation under Title III from
$55K to $75K, for subsequent
violations $150K is the maximum.
Lawsuits by individuals, Office of
Civil Rights (OCR), Demand Letters
from DOJ, and individual plaintiffs
can all be results of non-accessibility.
How Can Accessibility Help Your Business?
1 out of every 5 people have a disability.
57 Million in U.S.A.
Who do business, shop, and spend money on digital
with companies that make it easy for them using their
assistive technologies.
• It’s estimated that the spending power of this large
group of buyers is at $15 billion.
• 71% of those who visited a website, said they would
click off a site if they found it difficult to use.
• 82% of customers who had accessibility needs said
they would spend more time on a site if it were more
accessible.
Many disabled are exercising their rights under the ADA and filing
discrimination lawsuits or issuing settlement letters for huge sums of money.
The law firm of Seyfarth Shaw, who specialize in
accessibility law – AdaTitleIII.com has calculated that
Federal Website
Accessibility Lawsuits have
Nearly Tripled in 2018.
There were at least 2,258 digital accessibility lawsuits
in 2018 – a dramatic increase from the 814 such
lawsuits in 2017 and the 262 filed in 2016. The
number in 2019 is expected
This doesn’t taken into consideration businesses
who have settled before a lawsuit was file.
Being accessible is not just about
avoiding legal litigation.
Not only will accessibility satisfy the legal aspects
of accessibility, it can also...
• Increase your sales by reaching your full market for a
portion of the $15 billion disabled people are
spending.
• Set you out as a leader who values all customers.
• Open the possibility of working with government
agencies.
• It can possibly help with search engine results.

It is my desire to help businesses grow their business by reaching a market they
may be missing and protect their business from accessibility law suits.
It is also my focus to ensure those with disabilities are able to have the freedom
that comes from full use and enjoyment the Internet brings to so many who are not
disabled.
