LEGISLATION – The act of proposing a law
RESOLUTION – Is a legislative act which expresses the
general desire or sentiment which is specific in scope
and temporary in character
PARTS OF A RESOLUTION
1.] Heading – Should indicate the originating unit
a. Excerpt Portion – for Standard Format
b. Usually the names of present and absent members
are indicated – for Commission Format

2] Assigned or Resolution Number – The numerical series in
order of the barangay Resolution.
3] Title – Should express in one sentence the substance of the
entire Resolution
4] “Whereas” Clause – Should give the reasons for the adoption
of the Resolution in logical sequence
5] Primary Resolutory Portion – Should reflect what the
Sangguniang Barangay feels or desires
NOW THEREFORE, upon unanimous accord of the body, be it
RESOLVED, to confirm the appointment of Mr. Solanzo as the
new Barangay Treasurer

6] Secondary Resolutory Portion – Should show the
entire sentiment of the Resolution and how it would
reach the person or entity that would act on the wishes

FORMAT OF RESOLUTIONS

1. STANDARD FORMAT – Commonly
used by private organizations,
wherein the Secretary certifies to
the correctness of the Resolution
and the Presiding Officer attest
that the Resolution was duly
adopted, and the Punong Barangay
approved the Resolution. The
Excerpt portion appears after the
heading.

2. COMMISSION FORMAT – Commonly used by
“Commissions” or “Boards” exercising regulatory
powers & is applicable in Resolutions containing
decisions, positions, or stand on certain issues. In this
format, all the members concerned are required to affix
their signature as to the nature of their votes such as:
“Concurring”, “Dissenting” or “Abstained”. There is no
“Excerpts” nor “Certification” made by the Secretary.
The Secretary merely attests that the signatures were
that of the signatories appearing thereon. This format
should be used when the Resolution pertains to money
or financial matters.
* In case the Resolution pertains to a request to higher level
of government, the Resolution should always be noted
by the LCE in observance of proper protocol

WHEREAS, Mr. Felix B. Cortez is a resident of Barangay ___________, City of Ilagan, Isabela won a Gold Medal in Taekwondo event during the recently
concluded Batang Pinoy Games held in Sta. Cruz, Laguna;
WHERAS, this accomplishment of Mr. Felix B. Cortez has earned for himself the respect and admiration of the National Sports Commission, and for Barangay

A RESOLUTION CONFIRMING THE APPOINTMENT OF MR. ADRIANO B. CLARO AS THE NEW BARANGAY SECRETARY

WHEREAS, there is a need to appoint a new Barangay Secretary in this barangay
due to the recent resignation of Mr. Abraham S. Roque as Barangay Secretary;
WHEREAS, the appointment of Mr. Adriano B. Claro as the new Barangay Secretary is deem necessary for the continuous transactions of the
barangay;
WHEREAS, Mr. Adriano B. Claro is well known as having a good moral reputation and his reputation and appointment
as the new Barangay Secretary is in accordance to RA 7160 otherwise known as the Local Government Code of 1991;
NOW, THEREFORE, upon unanimous accord of the body, be it

2. ORDINANCE – Is a legislative act of that is permanent in character and
general in scope. It is subject for a review by the higher Sanggunian within 30
days upon receipt thereof.
REQUISITES OF A VALID ORDINANCE
1. It must not contravene the constitution or any statute;
2. It must not be unfair or oppressive;
3. It must not be partial or discriminatory;
4. It must not be prohibitive but may regulate trade;
5. It must be general and consistent with public policy;
6. It must not be unreasonable
REVIEW OF BARANGAY ORDINANCES
a] The Ordinance of the Barangay must be submitted within 5 days
to the next higher Sanggunian for review and must be posted in 3
conspicuous places in the barangay.
b] The SB concerned shall review the proposed Ordinance within 30
days. If it was not returned to the barangay with the proposed
amendments, then it is deemed presumed approved as a whole.

EFFECTIVITY OF THE ORDINANCE

- 10 days from the date of posting
- Posting should be placed in at least 2 other
conspicuous places
- Posting should be done not later than 5 days
after its approval
- After 10 days of posting, the said Ordinance
may now be implemented unless the said
ordinance is returned by the Sangguniang
Barangay with the proposed amendment.

TYPICAL KINDS OF ORDINANCES

1] APPROPRIATION ORDINANCE – Is an ordinance whose primary aim
is to appropriate local funds for purposes allowed by existing laws. It is a
pre-requisite before local funds could be spent.

AN ORDINANCE APPROPRIATING THE P 797,000 FROM THE ADDITIONAL
INTERNAL REVENUE ALLOTMENT AS SUPPLEMENTAL BARANGAY
BUDGET FOR CALENDAR YEAR 2015

2] TAX ORDINANCE – Is an ordinance enacted by the local legislative
body in the exercise of taxing power whose primary purpose is to raise
local revenues thru the imposition or levying of taxes, fees and charges
subject to certain limitations prescribed by law.

AN ORDINANCE IMPOSING A FEE FOR THE ISSUANCE OF A BARANGAY
CLEARANCE, LUPON CLEARANCE, AND BARANGAY CERTIFICATION

3] SPECIAL ORDINANCE – Is an ordinance which is
aimed for a special purpose such as naming or renaming
a barangay road, adopting the five-year Barangay
Development Plan, or creating a plantilla position in the
barangay.

4] GENERAL ORDINANCE – Is an ordinance enacted by
a legislative body in the exercise of its police power whose
primary aim is the general welfare of the people by

4] Enacting or Ordaining Clause – Indicates the enacting
or ordaining authority or the source of the Ordinance

SECTION 1. No person shall use any portion of the
public highway or any public road, park or square

commodity, or for any other similar purposes.

6] Penal Clause – Indicates the provision of penalty on the
violation of the Ordinance. This is part of an Ordinance is applicable
only to General Ordinances and Tax Ordinances

SECTION 3. PENALTY. Violation on any provisions of this
Ordinance shall be penalized by a fine of not less than
P200 but not more than P 1,000.

7] Repealing Clause – Indicates the statement of amending, or
repealing other earlier approved Ordinances that is not consistent
with the provision of the present Ordinance. Appropriation
Ordinances does not have “Repealing Clause” while Special
Ordinances seldom carry a “Repealing Clause”.
SECTION 4. Repealing Clause. All Ordinances, rules and
regulations, or part thereof, whose provision is
inconsistent or in conflict or contrary to the provisions of
this Ordinance are hereby repealed, amended and/or
modified accordingly.

8] Effectivity Clause – Indicates the date when the Ordinance shall take effect.
SECTION 5. This Ordinance will take effect immediately.

AN ORDINANCE REGULATING THE DISPOSAL OF GARBAGE AND WASTE WITHIN THE BARANGAY
Be it enacted by the Sangguniang Barangay, that:
Section 1. Garbage and Waste. The collection of garbage shall be in accordance with the provisions of the Ecological Waste Management Act of 2001, wherein those segregated waste and
garbage to be collected shall be as follows:
•Compostable Garbage and Waste
Bio-Degradable Waste – Those that do not easily decompose and being treated by chemical to avoid the emission of chemical foul odor such as dead animals, bones, and the like materials.
•Non – Compostable Garbage and Waste
Those garbage and waste that are not compostable such as rubber, Styrofoam, plastics, and the like materials.
Section 2. Collection. The above-mentioned waste and garbage shall be collected by the barangay garbage vehicle every morning from 7:30 to 10:00 from Sunday to Saturday and shall be in
placed in a used sack in front of every household
Section 3. Penalty. Any household who place any other waste inside their garbage sack aside from the above-mentioned waste and garbage shall be penalized as follows:
First Offense – P 500.00
Second Offense - P 750.00
Third Offense and there after - P1,000.00
Section 4. Repealing Clause. All Barangay Ordinances, Rules and Regulations, or part thereof, in conflict, or contrary to the provisions of this Ordinance of part thereof, are hereby repealed,
amended, or modified accordingly.
Section 5. Effectivity. This Ordinance shall take effect after 30 days from the date of its approval.

RESOLUTION ADOPTING THE INTERNAL RULES OF PROCEDURE OF THE SANGGUNIANG BARANGAY OF

WHEREAS, THE SANGGUNIANG BARANGAY IS A LEGISLATIVE BODY DULY ORGANIZED PURSUANT TO THE PROVISIONS OF THE LOCAL
GOVERNMENT CODE OF 1991 (RA 7160) TO ADOPT AND ENACT RESOLUTIONS AND ORDINANCES FOR THE EFFECTIVE GOVERNANCE OF THE
PEOPLE OF CITY OF ILAGAN, ISABELA;

WHEREAS, PURSUANT TO SECTION 50 OF RA 7160 OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991, AND ARTICLE 103
OF ITS IMPLEMENTING RULES AND REGULATIONS, LOCAL SANGGUNIAN BODIES HAVE TO ADOPT AND UPDATE ITS EXISTING RULES OF
PROCEDURES FOR PROPER DISCHARGE OF LEGISLATIVE FUNCTIONS;

WHEREAS, IN THE MAINTENANCE OF GOOD ORDER IN SANGGUNIAN DELIBERATIONS, IT IS NECESSARY THAT SPECIFIC RULES BE
ADOPTED AND ENFORCED IN THE INTEREST OF EFFECTIVE LEGISLATION.
NOW, THEREFORE:
BE IT RESOLVED BY THE SANGGUNIANG BARANGAY OF _________________________, CITY OF ILAGAN, ISABELA TO ADOPT THE
FOLLOWING RULES OF PROCEDURES TO GOVERN ITS DELIBERATIONS.

RULE I
COMPOSITION
SECTION 1. COMPOSITION – THE SANGGUNIANG BARANGAY SHALL BE COMPOSED OF THE PUNONG BARANGAY AS
PRESIDING OFFICER, EIGHT (8) REGULAR MEMBERS ELECTED AT LARGE, AND THE SK CHAIRMAN AS AN EX-OFFICIO MEMBER.

SECTION 2. TERMS OF OFFICE – THE TERM OF OFFICE OF THE SANGGUNIANG BARANGAY SHALL ASSUME OFFICE ON
THE DAY AND IN THE SAME UNTIL THEIR SUCCESSORS SHALL BEEN DULY CHOSEN AND QUALIFIED.

SECTION 3. OATH OF AFFIRMATION – ALL MEMBERS OF THE SANGGUNIANG BARANGAY SHALL UPON ASSUMPTION OF OFFICE,
TAKE OATH OF OFFICE OF AFFIRMATION IN THE PRESCRIBED FORM, DULY SUBSCRIBED BEFORE A PERSON AUTHORIZED TO ADMINISTER
OATH.

RULE II
PRESIDING OFFICER AND HIS DUTIES

SECTION 4. THE PUNONG BARANGAY SHALL BE THE PRESIDING OFFICER OF THE SANGGUNIANG
BARANGAY. THE PRESIDING OFFICER SHALL VOTE ONLY TO BREAK A TIE.

IN THE EVENT OF THE INABILITY OF THE REGULAR PRESIDING OFFICER TO PRESIDE AT A SANGGUNIAN
SESSION, THE MEMBERS PRESENT AND CONSTITUTING A QUORUM SHALL ELECT FROM AMONG THEMSELVES A
TEMPORARY PRESIDING OFFICER. HE SHALL CERTIFY WITHIN TEN (10) DAYS FROM THE PASSAGE OF ORDINANCES
AND RESOLUTIONS ENACTED BY THE SANGGUNIANG BARANGAY.

SECTION 5. POWERS AND DUTIES OF THE PRESIDING OFFICER – THE PRESIDING OFFICER
SHALL;

A. PRESIDE OVER THE SESSION OF THE SANGGUNIANG BARANGAY;
B. PRESERVE ORDER AND DECORUM DURING SESSIONS AND IN DISTURBANCE OR DISORDERLY CONDUCT IN THE
SESSION HALL OR WITHIN THE PREMISES, TAKE MEASURES AS HE MAY DEEM ADVISABLE OR AS THE SANGGUNIAN
MAY DIRECT;
C. DECIDE ALL QUESTIONS OF ORDER, SUBJECT TO APPEAL BY SANGGUNIAN MEMBER IN ACCORDANCE WITH THIS
RULE;
D. SIGN ALL ACTS, ORDINANCES, RESOLUTIONS, MEMORIALS, WRITS, WARRANTS AND SUBPOENA ISSUED BY OR
UPON ORDER OF THE SANGGUNIAN;
E. TO DECLARE THE MEETING ADJOURNED TO SOME OTHER TIME OR PLACE IN CASE OF SERIOUS DISORDER OR
GREAT EMERGENCY;
F. THE PUNONG BARANGAY, AS PRESIDING OFFICER IS ENTITLED TO VOTE, BUT ONLY IN CASE OF TIE. HE MAY NOT,
HOWEVER, BE COMPELLED TO VOTE; AND
G. EXERCISE SUCH OTHER POWERS AND PERFORM SUCH OTHER FUNCTION AS MAY BE PROVIDE BY LAW, ORDINANCE
OR REGULATIONS.

THE REGULAR PRESIDING OFFICER SHALL NOT BE A CHAIRMAN OF ANY STANDING COMMITTEE, BUT SHALL HAVE A
VOICE AND VOTE IN ALL COMMITTEE DELIBERATIONS. HE MAY, HOWEVER, BE ELECTED AS CHAIRMAN OF ANY SPECIAL
OR AD HOC COMMITTEE WHICH THE SANGGUNIANG BARANGAY MAY ORGANIZE.

RULE III
BARANGAY SECRETARY AND HIS/HER DUTIES

SECTION 6. THE BARANGAY SECRETARY SHALL BE APPOINTED BY THE PUNONG BARANGAY WITH THE CONCURRENCE OF THE
MAJORITY OF ALL THE SANGGUNIAN BARANGAY MEMBERS. THE APPOINTMENT OF THE BARANGAY SECRETARY SHALL NOT BE
SUBJECT TO ATTESTATION BY THE CIVIL SERVICE COMMISSION.

SECTION 7. POWERS AND DUTIES OF THE SECRETARY – THE SECRETARY OF THE SANGGUNIAN SHALL;

A. ATTEND MEETINGS OF THE SANGGUNIAN AND KEEP A RECORD OF ITS PROCEEDINGS;
B. TO CALL THE ROLL OF MEMBERS, READ THE CALENDAR OF BUSINESS AND THE MINUTE OF THE PRECEDING MEETING, AND BY
HIMSELF OR THROUGH A READER DESIGNED BY THE PRESIDING OFFICER, TO READ THE PROPOSED ORDINANCES AND
RESOLUTIONS MESSAGE, COMMUNICATIONS, MEMORIALS, PETITIONS AND OTHER DOCUMENTS WHICH HE SHOULD REPORT TO
THE BODY OR THE READING OF WHICH IS REQUIRED BY THE SANGGUNIAN OR ORDERED BY THE PRESIDING OFFICER;
C. TO RECORD AND NUMBER ALL ORDINANCES AND RESOLUTIONS PASSED BY THE SANGGUNIAN WITH DATES OF THE PASSAGE
AND PUBLICATION OF THE SAME;
D. TO ATTEST (AND AFFIX THE CORPORATE SEAL) TO ALL ORDINANCES AND OTHER OFFICIAL ACTS OF THE SANGGUNIAN AND
CERTIFY TO THE APPROVAL OF ALL ACTS DULY APPROVED BY IT;
E. TO TRANSMIT TO THE PROPER COMMITTEES ALL MATTERS REFERRED TO THEM BY THE SANGGUNIAN OR THE PRESIDING
OFFICER;
F. TO SEND OUT APPROPRIATE NOTICES OF ALL CALLED MEETING AND PUBLIC HEARING;
G. TO FURNISH EACH MEMBER OF THE SANGGUNIAN WITH A COPY OF EVERY APPROVED ORDINANCE, RESOLUTIONS AND OTHER
OFFICIAL ACTS OF THE SANGGUNIAN WHICH THEY ARE ENTITLED TO RECEIVE;
H. KEEP CUSTODY OF ALL RECORDS OF THE SANGGUNIANG BARANGAY AND THE BARANGAY ASSEMBLY MEETINGS;
I. PREPARE AND KEEP THE MINUTES OF ALL MEETINGS OF THE SANGGUNIANG BARANGAY AND BARANGAY ASSEMBLY;
J. PREPARE A LIST OF MEMBERS OF THE BARANGAY ASSEMBLY AND HAVE THE SAME POSTED IN CONSPICUOUS PLACES WITHIN
THE BARANGAY;
K. FORWARD TO THE SANGGUNIAN BAYAN FOR REVIEW OF COPIES OF APPROVED ORDINANCES AND RESOLUTIONS APPROVING
AND ADOPTING THE LOCAL DEVELOPMENT PLANS AND INVESTMENT PROGRAMS FORMULATED BY THE LOCAL DEVELOPMENT
COUNCIL, THE MANNER PROVIDED IN SECTION 57 UNDER BOOK I OF THE LOCAL GOVERNMENT CODE OF 1991.
L. WILL MAKE A WEEKLY DETAIL REPORT FOR THE “OFFICER OF THE WEEK” AND POST IT TO THE BULLETIN BOARD OF THE
BARANGAY OR IN FRONT OF THE DOOR OF THE BARANGAY HALL’
M. EXERCISE SUCH OTHER POWERS AND PERFORM SUCH OTHER DUTIES AND FUNCTIONS AS MAY BE PROVIDED BY LAW OR
ORDINANCE.

RULE IV
THE BARANGAY TREASURER

SECTION 8. The barangay treasurer shall be appointed by the punong barangay with
the concurrence of the majority of all the sangguniang barangay members. The appointment of
the barangay treasurer shall not be subject to attestation by the Civil Service Commission.

SECTION 9. The barangay treasurer shall:

a. Keep custody of barangay funds and properties;
b. Collect and issue official receipts faxes, fees, contributions, monies, materials, and all other
resources accruing to the baranagy treasury and deposit the same in the account of the
barangay as provided under Title Five Book II of the Local Government Code of 1991.
c. Disbursements in accordance with the financial procedures provided in the Local Government
Code of 1991;
d. Submit to the punong barangay a statement covering the actual and estimates of income and
expenditures for the preceding and ensuring calendar years, respectively subject to the
provision of Title Five Book II of the Local Government Code of 1991;
e. Render written accounting report of all barangay funds and property under his custody at the
end of each year, and ensure that such report shall be made available to the members of the
barangay assembly and other government agencies concerned;
f. Certify as to the availability of funds whenever necessary;
g. Plan and attend to the rural postal circuit within his jurisdiction; and
h. Exercise such other powers and powers and perform such other duties and functions as
maybe prescribed by the law or ordinance.

RULE V
SESSIONS

SECTION 10. REGULAR SESSION – THE REGULAR SESSION OF THE SANGGUNIANG BARANGAY OF ________________,CITY OF ILAGAN,
ISABELA SHALL HOLD TWO (2) REGULAR SESSIONS EVERY MONTH WHICH SHALL BE HELD EVERY 1ST
AND 3RD
SATURDAY OF THE MONTH AT THE
BARANGAY HALL OR OTHERWISE DECIDED UPON BY THE MEMBERS. THE REGULAR SESSION SHALL START AT 9:00 AM.

SECTION 11. SPECIAL SESSION – WHEN PUBLIC INTEREST SO DEMANDS, SPECIAL SESSION OR EMERGENCY MEETING MAY BE CALLED
BY THE PUNONG BARANGAY/PRESIDING OFFICER OR BY A MAJORITY OF THE MEMBERS OF THE SANGGUNIAN.
IN CASE OF SPECIAL SESSIONS OR EMERGENCY MEETING OF THE SANGGUIAN BARANGAY, A WRITTEN NOTICE TO THE MEMBERS SHALL BE
SERVED PERSONALLY AT THE MEMBER’S USUAL PLACE OR RESIDENCE AT LEAST TWENTY FOUR HOURS (24) HOURS BEFORE THE SPECIAL
SESSION OR EMERGENCY MEETING IS HELD. UNLESS OTHERWISE CONCURRED IN BY TWO THIRD (2/3) VOTE OF SANGGUNIANG BARANGAY
MEMBERS PRESENT, THERE BEING A QUORUM, NO OTHER MATTER MAYBE CONSIDERED AT A SPECIAL SESSION EXCEPT THOSE STATED IN THE
NOTICE.

SECTION 12. CALL TO ORDER – THE PRESIDING OFFICER SHALL OPEN THE SESSION BY CALLING THE SANGGUNIAN TO ORDER.

SECTION 13. ATTENDANCE IN SESSION – EVERY MEMBER OF THE SANGGUNIAN SHALL BE PRESENT IN ALL SESSIONS, UNLESS
HE/SHE IS ON OFFICIAL TIME OR EXPRESSLY EXCLUDED BY IT OR NECESSARILY PREVENTED FROM DOING SO BY SICKNESS OR OTHER
UNAVOIDABLE CIRCUMSTANCES DULY REPORTED TO THE SANGGUNIAN THROUGH THE SECRETARY.

SECTION 14. OPEN TO THE PUBLIC - SANGGUNIAN SESSIONS OR MEETINGS OF ANY COMMITTEE THEREOF SHALL BE OPEN TO PUBLIC
UNLESS A CLOSE DOOR SESSION IS DECIDED OR ORDERED BY AN AFFIRMATIVE VOTE OF A MAJORITY OF THE MEMBERS PRESENT, THERE BEING
A QUORUM IN THE PUBLIC INTEREST OR FOR REASON AFFECTING THE DIGNITY OF THE SANGGUINIAN OR ANY OF ITS MEMBERS OR WHEN
CONFIDENTIAL MATTERS ARE BEING CONSIDERED.

ONLY THE SECRETARY TO THE SANGGUNIAN AND SUCH OTHER PERSONS THAT ARE SPECIFICALLY AUTHORIZED BY THE SANGGUNIAN, SHALL BE
ADMITTED IN CLOSED DOOR SESSIONS. THEY SHALL PRESERVE THE SECRETARY OF WHATEVER MAYBE READ OR SAID IN THE SESSION.

SECTION 15. SUSPENSION AND ADJOURNMENT OF SESSIONS – SESSIONS OF THE SANGGUNIAN SHALL NOT BE SUSPENDED OR
ADJOURNED EXCEPT BY DIRECTION OF THE SANGGUNIAN ITSELF, BUT THE PRESIDING OFFICER MAY, IN HIS DIRECTION, DECLARE A RECESS OF
SHORT INTERVALS.

SECTION 16. OPENING AND ADJOURNMENT TO BE ENTERED IN THE MINUTES – THE EXACT HOUR OF OPENING AND
ADJOURNMENT OF A SESSION SHALL BE ENTERED IN THE MINUTES.

RULE VI
ROLL CALL AND QUORUM
SECTION 17. Quorum - A majority of all the members of the Sanggunian who have been
elected and qualified shall constitute a quorum to transact official business.
Should a question of quorum be raised during a session, the presiding officer shall
immediately direct the sanggunian secretary to call the roll of the members and there after
announce the results.

SECTION 18. Absence of Quorum – W here there is no quorum in a given session, the
presiding officer may declare a recess until such time a quorum is constituted, or a majority of
a members present may adjourn from day to day and may compel the immediate attendance
of any member absent without justifiable cause by designating a member of the sanggunian,
to be assisted by a member or members of the police force assigned in the territorial
jurisdiction of the local govovernment until concerned, to compel the presence of the absent
member and present him at the session.

SECTION 19. Motion to Adjourn Vacates Call – At any time after the call has been
completed, a motion to adjourn shall be in order, and if approve by a majority of those present,
all proceedings shall be vacated.

SECTION 21. Limitation and Condition
A. No sanggunian barangay member shall be a chairman of more than one (1) standing committee
if there are still member who do not chair a committee.
B. The regular presiding officer of the sanggunian shall have a voice and vote in all committee.
C. The chairman of the committee on appropriation will be automatic chairman of the Committee
on Bids & Awards.
D. The chairman of the committee on rules, public order, investigation and security will be
automatic adviser and ex-officio member of the Barangay Tanod in this barangay.
E. No member of a committee shall act upon or participate in any matter which he has a special,
direct and substantial interest.

SECTION 22. Vacancy – whenever a vacancy occurs or is declaring to exist in any of the
committees, the same shall be filled by election by the sanggunian.

SECTION 23. Committee Hearings – The committee shall determine the frequency of
their meetings or hearings. A majority of all members of the committee shall constitute a quorum.

SECTION 24. Committee Reports and Orders – Committee report and/or orders on any
ordinance or resolution shall be considered in formal meetings and shall be submitted to the
sanggunian accompanied by the minutes of the meeting or hearing of the committee which adopted
them.

When a committee submits a report, the members thereof shall be presumed to have
concurred the report and shall be precluded from opposing the same, unless they have entered
their objection during the committee hearing.

RULE VII
ORDER AND CALENDAR OF BUSINESS
SECTION 25. Order of Business – The order of Business of the Sangguniang Barangay of ___________________,

SECTION 26. Approval of Minutes – The minutes of each session shall be submitted to the sanggunian for approval.

SECTION 27. Calendar of Business – The calendar of business consist of the following parts;

A. Unfinished Business – business considered by the sanggunian at the time of its adjournment. Its consideration shall be
presumed until such unfinished business is disposed of. Thereafter, the presiding officer shall call for the business for the day.

B. Business for the Day – proposed ordinances, resolution and other matters set on the calendar for consideration on that day, to
be considered in the order in which they listed in the calendar.

Those proposed measures must be submitted to the secretary of the sanggunian barangay not later than _____________________
( ) in the _______________ of every __________________ of the month.

C. Unassigned Business – proposed ordinances, resolutions and other measures reported out of the committees but not
calendared earlier. Any business included in this part of the calendar may be set for consideration on of a member with unanimous
approval of the sanggunian members present at the session, there being a quorum.

RULE VIII
ORDINANCES AND RESOLUTIONS

SECTION 28. ORDINANCES AND RESOLUTION DISTINGUISHED – LEGISLATIVE ACTIONS OF A GENERAL AND PERMANENT CHARACTER
SHALL BE ENACTED IN THE FORM OF ORDINANCES, WHILE THOSE ARE OF TEMPORARY CHARACTER SHALL BE PASSED IN THE FORM OF RESOLUTIONS. MATTERS
RELATING TO PROPRIETY FUNCTIONS AND TO PRIVATE CONCERNS SHALL BE ACTED UPON BY RESOLUTIONS.

SECTION 29. THREE-READING PRINCIPLE – THE SO-CALLED “THREE READING PRINCIPLE” COMMONLY ADOPTED IN LEGISLATIVE BODIES
SHALL BE FOLLOWED BY THE SANGGUNIAN BEFORE AN ORDINANCE IS FINALLY ENACTED. IT SHALL UNDERGO THE FOLLOWING STAGES.

A. FIRST READING – AT THIS STAGE, THE SECRETARY SHALL READ THE NUMBER OF THE PROPOSED DRAFT ORDINANCE, ITS TITLE, NAME OF THE AUTHORS OR
THE NAMES OF THE MEMBERS INTRODUCING IT. THEREAFTER, THE PRESIDING OFFICER SHALL REFER IT TO THE APPROPRIATE COMMITTEE OR COMMITTEES. AT THIS
STAGE, NO DEBATE SHALL BE ALLOWED.
B. SECOND READING – AT THIS STAGE, ANY PROPOSED ORDINANCE THAT HAS ALREADY BEEN CALENDARED BY THE COMMITTEE ON RULES FOR “SECOND

RULE IX
DECORUM AND DEBATE

SECTION 30. Manner of Addressing the Chair – When a member desires to speak, he shall raise his hand and
respectfully address the chair, “MR./HON. CHAIRMAN” or MR./HON. PRESIDING OFFICER”.
SECTION 31. Recognition of Members to Speak – When two or more members raise at the same time, the
presiding officer shall determine and recognize who to speak first.

SECTION 32. Time Limit for Speeches – No member shall occupy more than fifteen (15) minutes in debate or any
question. The period of interpellation shall not be counted against the time of the member speaking.

SECTION 33. Sponsor to Open and Close Debate – The member reporting a measure under the consideration from
a committee may open and close the debate thereon. If the debate should extend beyond one session day, he shall be entitled to an
additional fifteen (15) minutes to close.

SECTION 34. Decorum to Open and Close Debate – In all cases, the member who obtained the floor shall continue
himself to the question under debate avoiding personalities. He shall refrain from uttering words or performing acts which are
inconsistent with decorum.

SECTION 35. Conduct During Session – During session, the members shall observe decorum and to be in proper
attire (any pants, white t-shirt with collar).

While the presiding officer is addressing the sanggunian or putting question, no member shall go out across the
session hall.

SECTION 36. OFFICE HOURS AND “OFFICER OF THE DAY”

SECTION 37. Discipline of Member – The Sanggunian may punish its members for disorderly behavior or absences
without any justifiable cause for four (4) consecutive sessions, for which they may be censured, reprimanded or excluded from
session, suspended for not more than sixty (60) days, or expelled, provided, that the penalty of suspension or expulsion shall require
the concurrence of at least (2/3) vote of all sannguniang barangay members provided further, that a member convicted a final
judgment or imprisonment of at least one (1) year for any criminal involving moral turpitude shall be automatically reported to the
Local Chief Executive for his/her information for the proper updating of the Leave Records of the elective official/s concerned.
Justifiable cause includes the following:
A) When the member is On Official Business with approved Travel Order and Proof of Travel
B) When the member is sick and must inform the body.

RULE X
DISCIPLINARY ACTIONS (SEC. 50, par 5)

SECTION 38 . Penalty – any member who commits an act in transgression of the foregoing internal rules of procedures hereunder
prescribed to wit:
OFFENSE PENALTY
1. For “justified” absence with prior notice. NONE.
2. For any “justified absence” without prior notice. Fine of not more than Php_____.
3. For any “unjustified absence” without prior notice. Fine of not less than Php_____, but not more than Php_____.
4. For “unjustified absences” in four (4) consecutive sessions. Fine of not less than Php _____, but not more than Php _____
and or corresponding administrative charges before the

Automatic Expulsion.
7. For refusal without valid excuse to perform the task assigned
to him by the Sanggunian or committee of which he is a
member.
Suspension for not more than one (1) month without any kind of
privilege.
8. For “unjustified absence” in committee hearing or meeting or
which he/she is a composite member
Fine of not less than Php _____, but not more than Php ____,
without prejudice filing of the corresponding administrative
charge.
9. For violation of any other provision of this Internal Rules of
Procedures not specified herein.
Fine of not less than Php _____, but not more than Php _____,
suspension or expulsion as maybe decided by two thirds (2/3)
vote of all the members of this Sanggunian.
10. For not wearing prescribed attire. Fine of Php _____.

RULE XI
VOTING AND MOTIONS

SECTION 39. Voting in the Sanggunian – it shall be done by voice, raising of hand, or by roll call, unless a different method is
prescribed by the sanggunian for a particular question. In taking the vote the affirmative shall be taken first and then the negative.

SECTION 40. Tie Vote – a tie vote defeat any measure or motion except an appeal from the ruling of a chair sustains the
decision of the chair.

SECTION 41. WHO MAY VOTE -
SECTION 42. Records of Motion – Every action shall be entered in the minutes with name of the member making it, unless it is
withdrawn on the same day.

SECTION 43.Reading and Withdrawal of Motion – When a motion is made, the presiding officer shall take it before being
debated, except herein otherwise provided motion may be withdrawn anytime before its approval or amendments.

SECTION 44. Precedence of Motion – refer to the Local Legislators’ Tool Box.

SECTION 45. Amendments – When a motion or proposition is under consideration, motion to amend that amendment shall be in
order. It shall also be an order to offer further amendments by substitution, but it shall be voted upon until the original motion or proposition is
perfected. Any said amendments maybe withdrawn.

SECTION 46. Motion to Cover One (1) subject Matter – No motion shall be ambiguous.

SECTION 47. Amendment of Title – Amendment of Title of a proposed ordinance or resolution shall not be in order until after
the next thereof has been perfected. Amendment to the title shall be decided without debate.

SECTION 48. Call to Order – A motion to read any part of the rule is equivalent to a call to order and takes precedence over any
motion other than to adjourn.

SECTION 49. Question of Privilege – Question of Privilege are:

a. Those affecting the rights of the Sanggunian, safety, dignity and integrity of its members.
b. Those affecting the rights, reputation and conduct of members individually, in their capacity as such members.

Subject to the five (5) minutes rule, question of privilege shall have precedence over all other question except a motion to adjourn.

SECTION 50. Privilege Question – Privilege questions are those motion or subject matters which
under the rules, take precedence over other motion and subject matters.

RULE XII
SUSPENSION OF THE RULES

SECTION 51. WHO CAN MOVE – ONLY A CHAIRMAN OR MEMBERS OF THE COMMITTEE ON INTERNAL RULES,
LAWS AND INVESTIGATION, PUBLIC ORDER AND SECURITY CAN MOVE FOR THE SUSPENSION OF THE RULES, IN CASE
ALL THE MEMBERS ARE ABSENT, ANY MEMBER CAN MOVE PROVIDED HE IS RECOGNIZED BY THE CHAIR.

SECTION 52. VOTE REQUIRED – NO RULE SHALL BE SUSPENDED EXCEPT BY A VOTE OF TWO-THIRDS (2/3) OF
THE MEMBERS PRESENT, THERE BEING A QUORUM.

SECTION 53. INTERRUPTION OF MOTION – WHEN AN ACTION TO SUSPEND THE RULE IS PENDING NO MOTION
TO ADJOURN MAY BE ENTERTAINED. IF IT IS LOST, NO SIMILAR MOTION SHALL NE ENTERTAIN UNTIL THE VOTE IS TAKEN
ON THE MOTION TO SUSPEND.

SECTION 54. EFFECT OF SUSPENSION – IF THE SANGGUNIAN VOTE TO SUSPEND THE RULES, IT SHALL
FORTHWITH PROCEED TO CONSIDER THE MEASURE. A TWO-THIRDS (2/3) VOTE OF THE MEMBERS PRESENT SHALL BE
NECESSARY FOR THE PASSAGE OF SAID MEASURE, A QUORUM BEING PRESENT.

WHAT IS THE EXTENT OF THE FOURTH CIVIL
DEGREE OF RELATIONS EITHER BY BLOOD
OR BY AFFINITY?
The fourth civil degree of relations either by blood or by affinity extends to one’s (a)
great grant parents in the direct line of ascendancy, (b) great grant grandchildren in the
direct of descendancy; (c) first cousins; and (d) great grand uncles and aunts in the
collateral line (DILG OPINION 21, s. 2008).

DISTINGUISH HONORARIUM FROM SALARY
Honorarium is something given not as a matter of obligation but in appreciation for
services rendered, a voluntary donation in consideration of services. It is a
remuneration given to a public official for services actually rendered
On the other hand, salary is the personal compensation to be paid to a public
officer for his services and it is generally fixed annual or periodical payment depending
on the time and not on the amount of the services he may render.

HOW MANY PARTS DOES THE HONORARIUM
FOR THE SANGGUNIANG BARANGAY
MEMBERS HAVE?
It can be divided into two (2) parts, each representing each
session (DILG Opinion 2, s. 2010)

If a sangguniang barangay member will be
absent in one of the two sessions for the
month, is he still entitled to his honorarium?
YES – but he is entitled only the proportionate amount of
honorarium for services actually rendered (DILG Opinion 2, s. 2010).

If a sangguniang barangay member will be
absent in both sessions of the month, is he
still entitled to his honorarium?
NO – he can be deprived of his total honorarium for that month.

How many sessions in a month are required to be
attended by a sangguniang barangay member?
Sangguniang barangays are mandated to conduct at least two sessions in
a month (Sec 52, RA No. 7160).

Can a punong barangay who went out of the
country still collect his honorarium?
NO – there was no actual service rendered
(DILG Opinion 23, s. 2005).

An elective barangay official took a leave of
absence during the holding of sessions. Is he
entitled to his honorarium?
NO – there was no actual service rendered (DILG Opinion 163, s. 2002).

Can the barangay government validly
withhold the honorarium due to a

YES – the barangay government can validly withhold the honorarium due to a
sangguniang barangay member who failed to render actual services due to his
