is collected
PRIVACY POLICY
Websites or apps that collect personal
information are required by both laws
and third-party platforms to have a
Privacy Policy.
Privacy Policy
Email addresses
Phone numbers
Birthdates
First/last names
Mailing addresses
IP addresses
Geolocational data
Banking and financial
account information
Personal
information is
anything that can be
used to identify an
individual, such as:
Laws that require a Privacy Policy include:
The GDPR (1) - EU
PIPEDA (2) - Canada
CalOPPA (3) - USA

Third-party platforms that require a Privacy
Policy include:
App stores (4)
Facebook (5)
Google Analytics (6)

So, what if your website or
mobile app doesn’t directly
collect personal information?
Do you still need a Privacy
Policy?
The short answer is yes.
Here’s why:
Third-party services you use
may be collecting personal
information even if you
aren’t
Your users expect you to
post one
Third Party Services
Some third-party services
like Mailchimp and Campaign
Monitor work by collecting
personal information from
your users, such as email
addresses.
PRIVACY POLICY
Because of this, these services
require their users - that’s you
- to post a Privacy Policy.
This keeps them - and you -
legally compliant.
Check the third-party service’s Terms and
Conditions and Privacy Policy to verify:
What personal information the
service collects, and
If you’re explicitly required to
have a Privacy Policy
PRIVACY POLICY
If you:
Don’t collect personal information,
and
Don’t use third party services that
collect personal information…
...you should still post a Privacy Policy.
User Expectations
Even if nobody reads your Privacy Policy, people
will surely notice if your website footer or app
menu doesn’t include a link to one.
While you’ll know you don’t have one because
you don’t collect any personal information,
your users won’t know this.
They may assume you have
shady privacy practices that
you’re choosing to not disclose.
Now that you’re
convinced that you need
a Privacy Policy, what
should it look like?
If you don’t collect personal information but
use a third-party service that does, let your
users know that:
You don’t collect or store any
of their information, and
Another party does
Privacy Policy if No Personal Data is Collected
If you don’t collect personal information and
aren’t using any third parties that do, let
your users know just that.
A Privacy Policy is still a
Privacy Policy, even if it’s
only a few sentences long.
PRIVACY POLICY
Once you have your Policy created,
make it easily accessible to your
users from your website/app.
