THE NARCOTICS CONTROL
ACT,1990
 131-29-500
 May be called the Narcotic Drugs and Psychotropic Substances
Control Act.
 Come into force : 02/01/1990.
Purpose : To control of narcotic drugs and psychotropic
substances and treatment and rehabilitation of narcotics addicts
Amended: 2000, 2002 and 2004 in order to update the law.
The Narcotics Control Act,1990
1.To fulfill the objectives of this Act, there shall be a Board namely National
Narcotics Control Board.
2. Total Members-19
1. A Chairman.
2. Minister in charge of the Ministry or Division of Foreign Affairs ; Home
Affairs ; Health; Education ; Information ; Social Welfare and Women Affairs
;Finance ; Planning ; Local Government ; Religious Affairs ; Youth and Sports
; Law and Justice -12
3. Distinguished social worker , philanthropist , intellectual , journalist ,
physician or psychiatrist-5
4. Director General, who shall also be the Secretary of Board.
National Narcotics Control Board
3. If there is no Minister in a Ministry or Division as mentioned in
Sub-section (2) then the State Minister in charge of that Ministry or
Division, if any, shall be the member of the Board.
(4) Terms :Two years from the date of his nomination : Government
may cancel nomination at anytime.
(5) Any nominated member may resign from his office by a letter
addressed to the Government under his signature

FUNCTIONS A ND R ESPONSIBILITIES
OF THE BOA R D. —
1. To frame policies relating to-
1. Prevention of possible injurious effects of narcotics and to take
measures for their implementation ;
2. Treatment and rehabilitation of narcotics addicts and to take
measures for their implementation ;
3. Research or survey for the collection of data and information s
4. To manufacture, supply, use, and control of narcotics ;
2. Create educational and public awareness about the evil effects of
narcotics
3. To maintain liaison with all the concerned Ministries and Agencies
MEETING
1. Board have to Determine the procedure of
meetings.
2. Shall be held at the place and time as determined by
the chairman.
3. The chairman shall preside over all meetings of the
board and in his absence any other member of the
board nominated by him shall preside.
4. The quoram of a meeting of the board shall be
constituted by one-fourth of the total members.
PROVISION FOR
PRODUCTION OF ALCOHOL
(l) No person without any licenses issued under this Act—
• (a) Shall establish any distillery or brewery ;
• (b) Shall produce, process, carry, transport, import,
export, supply, purchase, sale, possess, preserve,
warehouse, exhibit or use any alcohol ;
• (c) Shall use any alcohol as a component for the
production of any medicine.

2) No person shall drink alcohol without a written
prescription given by a physician
3) prescription must contain the name of the disease for
which drinking of alcohol has been considered necessary
for treatment.
4) Foreign citizen may drink alcohol in a licensed Bar.
R E S T R I C T I O N S O N P R E S C R I P T I O N O F
NA RC OT I C S . —
 (1) No physician shall prescribe any A-Class or B-Class narcotics
as medicine without written approval of the Director General.
 (2) No person other than a physician shall prescribe any C-Class
narcotics as medicine.
 (3) No person shall be allowed to purchase any narcotics more
than once with a prescription issued under sub-section (1) or (2).
NARCOTICS ADDICTION
TREATMENT CENTRE.—
(1) The Government may establish none or more Narcotics
addiction treatment center for the purposes of this Act.
(2) The Government may declare any Government hospital
or health center including a jail hospital as a Narcotics
Addiction Treatment Centre by notification in the official
gazette.
PENALTY
 For Heroin, Cocaine and Coca derivatives , Pethidine, Morphine
Tetrahydrocannabinol , Opium, Cannabis resin or opium derivatives,
Methadone - 6 months to death sentence or imprisonment for life.
 Other 'A' Class Narcotics : Imprisonment 2 - 15 years.
 Other B-Class narcotics : Imprisonment 6 months -5 years.
 C-Class narcotics : Imprisonment not more than 1 year or fine not
exceeding Tk. 10 thousand or with- both.
‘A’ CATEGORY NARCOTICS
1. Opium poppy and the sticky substance discharged
therefrom.
2. Any refined, unrefined, manufactured opium or any
substance made together with opium.
3. Opium derivatives, viz. Morphine, Codeine etc. and
their basic salts.
4. Any substance containing more than 0.2% of
Morphine.
‘B’ CATEGORY NARCOTICS
1. Hemp plant, Herbal cannabis, “Bhang”, “Bhang”
plant or any substance prepared with “Ganja” or
“Bhang”.
2. Any plant (except tobacco) which may be used as a
source of intoxicant.
3. Alcohol, wines of all kinds, rectified spirit, any drug
or liquid prepared with rectified spirit, beer or any
liquid with alcohol content of more than 5%.
‘C’ CATEGORY NARCOTICS
Liquor from date or palm juice (“Tari”),
fermented rice liquor etc.
Denatured spirit or Methylated Spirit.
Any sedative, tranquilizer or hypnotic drug
not included in cat- “B”.
