مساواة الفرع للأصل في علة حكمه أركانه : الفرع، والأصل، والعلة، والحكم . ( الحشيش كالخمر في الحرمة للإسكار ). فالحشيش فرع لأنه يقاس على شيء آخر ويلحق به . وكالخمر : هو الأصل ، لأنه المقيس عليه . وفي الحرمة : هو الحكم ، لأنه الوصف الشرعي المنقول من الأصل إلى الفرع . والإسكار : هو العلة التي من أجلها شرع الحكم في الأصل، وبسبب وجودها في الفرع مساوية للأصل نقل الحكم من الأصل إلى الفرع . Sources of Jurisprudence Definition: الصحابي عند الأصوليين : هو من لقي النبي ( ص ) مؤمنا به ولازمه مدة طويلة بحيث يجوز إطلاق لفظ الصاحب عليه عرفا ولغة ( أصحابي كالنجوم بأيهم اقتديتم اهتديتم ) Companion: Who met the Prophet PBUH, believing in him, and stayed with him enough time learning and keeping company with him, so it is acceptable by social customs and language to call him a “companion” Sahaba’s Rulings قول الصحابي
