- 5. Understanding the Durbin Amendment Undoubtedly, the Durbin Amendment has received a lot of press coverage lately. You’ve probably heard that it can save you money on your debit card processing fees, but chances are you’re not exactly sure what impact it will have on your business. What is the Durbin Amendment? This new regulation originated from the Dodd-Frank Wall Street Reform and Consumer Protection Act, which was passed in 2010 in response to the 2008 financial crisis. The specific area that impacted debit interchange is commonly known as the “Durbin Amendment.” The law required the Federal Reserve Board to establish standards and rules for processing debit card transactions, including limits on fees. The Fed’s final rule took effect on October 1, 2011. The card associations and debit networks have updated their interchange rates to comply with the new rules. Why is the Durbin Amendment important to me? Since October 1, 2011, when the Durbin Amendment took effect, interchange for debit card transactions has been dramatically reduced. This means that you can now save up to 60% on your debit card processing costs. What types of cards does Durbin impact? What impact will the Durbin Amendment have on my business? The savings you will see from the Durbin Amendment depend on three factors: 1. The amount of regulated debit cards used at your business (as opposed to exempt debit cards). 2. The size of your average ticket. (Merchants with larger tickets will typically experience higher savings.) 3. The type of pricing plan you have with your merchant services provider.
