WHAT IS THE PURPOSE OF COPYRIGHTS
FAIR USE ESTABLISHED
• Established in 1976
• „Copyrighted materials may be used without express permission
of the copyright holder under certain conditions
FAIR USE GUIDELINES
Section 107 has four factors
• Educational use/ non--profit
• Nature of copyrighted work
• Excerpt or portion of work
• Cannot impair marketability
TEACH ACT CHANGES (2002)
• Expands categories of works that can be performed in DE to limited & reasonable portions
• ‹ Removes concept of physical classroom
• ‹ Allows storage of copyrighted materials on a server to permit asynchronous
performances & displays
• Permits institutions to digitize works to use in distance education
• ‹Clarifies that participants in DE courses are not liable for infringement
THE DO’S AND DON’TS OF COPYRIGHT
INFRINGEMENT
Books and Periodical Tables
• Copying cannot be used to create or substitute for anthologies.
• Copying from “consumable” works such as workbooks or exercises is forbidden no matter
what the salesman says. •
• Copying is not a substitute for purchasing nor can the same teacher copy the same thing
term after term.

Television and Video
• Television programs may be taped for in-class use under the fair use guidelines.
• Only copy prerecorded tapes with the publisher’s permission.
• Student-teacher created tapes can be copied as time allows

Internet
• Material may not be posted from another Web site without permission.
• Material from the Internet may not be compiled into a new work.
• Copyright material cannot be scanned for school use.
• Compilations such as phone books
• Materials in the public domain
• Freeware (but not shareware)
• U.S. government works
• Facts
• Ideas, processes, methods, and
systems described in copyrighted
materials

Copyright protection does not apply to the following list of
items, and you are free to use them as you please:
