TRAI has issued new regulations prohibiting discriminatory data tariffs based on content. The regulations aim to ensure net neutrality and that consumers have unhindered access to the internet without discrimination regarding content. TRAI held consultations on the issue, receiving many responses from stakeholders with diverse views both supporting and against regulating differential tariffs. After consideration, TRAI decided ex ante regulation provided more certainty than case by case interventions. The new regulations mandate no discriminatory tariffs based on content and prohibit agreements aimed at evading this. Reduced tariffs for emergency services are permitted. TRAI will monitor implementation and may review the regulations after two years.
