Will there be a revised #DAC6 in early 2026? The most recent ECOFIN meeting on 20 June concluded that the EU wouldn't pursue #UNSHELL as a standalone DAC10, but it would be better added to the DAC6 hallmarks. Senior Partner, The Hon Albert Isola CBE introduced and moderated the first panel of the day on “Decrypting the Myths about Crypto & Gaming”. The panellists included Andrew Lyman, William Gracia, Chris Elliott Andreas Glarner, and Anthony Provasoli Gaming Partner Steven Caetano then joined the panel on M&A, focusing on “The Legal Perspective”. Moderated by Simon French and joined by fellow panellists Tamsin Blow, Elizabeth Dunn, Andrew Montegriffo and Susan Breen ISOLAS final speaker of the day was Associate Katrina Isola who sat on the ESG panel discussing sustainability. Other panellists included Sarah Powell, Lauren Iannarone, Ty Smith CMgr FCMI and Ben Wright. The session was moderated by Russell Mifsud. In addition to the scheduled agenda Gibraltar’s Chief Minister Fabian Picardo made a whistle stop visit to update all present on the historic EU and UK post-BREXIT agreement in respect of Gibraltar which was very well received by all present. Huge congratulations to KPMG Gibraltar on another spectacular eSummit. This years was truly exceptional and when Chief Minister Fabian Picardo popped in to give the Industry an update on the news of the Treaty between the UK and the EU in respect of Gibraltar the summit was buzzing. The final panel session with the Operators gave some hint of the significance of the Treaty to this sector, and the excitement there is for what’s to come. I much enjoyed introducing and moderating the opening panel on Crypto and Gaming which was made easy by the quality of the panellists. Power Presentation at the KPMG Gibraltar #KPMGeSummit from the team at Hassans. What do the impending changes to the regulatory landscape in Gibraltar mean for Marketing Companies? With Gaming companies not being able to claim VAT back - VAT efficient strategies are common in the sector. This makes Gibraltar and it’s No VAT regime attractive. However large scale operations with very little substance in Gibraltar are causing the jurisdiction to feel exposed. The issue is summarised nicely in this quote “I personally have seen brass plate style operations with very little substance in [in Gibraltar] claiming that they are not accruing and supplying [not paying tax] but then claiming VAT benefits”. The new Act will bring an overnight ban on this type of operation but will allow activity with exception. Those coming into the licensing regime can expect guidelines soon but will be required to: * prove structure won’t be negative to Gibraltar * VAT structuring will be back-tested - note VAT advice here will be critical * demonstrate how much they will contribute financially and employment opportunities to Gibraltar * understand that a low tax spend will not be considered favorably Illustrative example cited as 100 people involved in Marketing for a company - 1 Director being based in Gibraltar (the rest somewhere else) and trying to claim substance. This will be a huge NO! Guiding principle - the more you have in Gibraltar the safer you will be. Final advice - Go back to your original advice and TRULY test whether it has been applied in full.
