Day 4 Notes (write this down) (TCI Ch4) Essential Question: How and why did the framers distribute power in the Constitution?
Notes (part 1) 3 parts to Constitution Preamble - defines the purpose of Constitution and goals of our gov’t form a more perfect union, establish justice . . .
Parts of Constitution 2nd part - Articles - main body of Const. - 7 articles - divided into sections and clauses 3rd part - Amendments
Article 1 - Legislative Branch describes Congress, election, terms, qualifications, rules, etc. Enumerated powers - powers specifically listed in Constitution Implied powers - from Necessary and Proper Clause (Elastic Clause) - Congress can “make all laws necessary and proper” for carrying out its duties
Article II - Executive Branch article II establishes the executive branch, led by president - describes term, qualifications, powers, etc.
Article III - Judicial Branch article III establishes judicial branch, creates Supreme Court Congress to make lower federal courts defines jurisdiction of federal courts
other articles article IV - relations among states - states must honor laws and citizens of other states, Congress can make new states article V - describes amendment process article VI - contains Supremacy Clause - “supreme Law of the Land” article VII - ratification process (9 states)
Amending Constitution is difficult to amend 2 step process - proposal and ratification Proposal - 2/3 vote of each branch of Congress OR request of 2/3 of state legislatures (never used) Ratification - 3/4 of state legislatures OR 3/4 of special state conventions (only used once)
Amendments 1-10 - Bill of Rights 13, 14, 15 Civil War era amendments 16-27 other amendments 19 - women vote 18 and 21 prohibition 26 - lowered voting age to 18
