10 Things to Consider to Avoid Litigation
Number 1
When creating websites, it is
important to ensure that the
written agreement specifies that
you own it.
Number 2
Once created, the website exposes
the company to the world.
Consideration should be given to
issues regarding jurisdiction and
 exposure to lawsuit and criminal
prosecution.
Number 3
Privacy policies should be clearly
stated and posted on the website.
Once posted, companies should
ensure that they comply with their
own policies.
Number 4
Framing and Linking.
Linking connects a web surfer from
your website to another site.
Framing is to have a link that only
changes a portion of the display of the
browser.
Permission should be obtained from
the owner of the other site.
Number 5
Ensure that the webwrap
agreement that links to the site’s
terms and conditions is available
from your site.
Number 6
Ensure that you are not infringing
on the copyright of another
business, whether online or
otherwise.
Number 7
Trademarks apply online as well.
This includes logos, slogans, etc.
Number 8
Be sure to protect your own
intellectual property by including
notices on your website.
Copyrights, trademarks and the
website itself should be registered
with government agencies.
Number 9
Advertise product liability laws and
consumer protections laws.
Number 10
Have a procedure for backup and
archiving the website.
